Introduction
By using or visiting the website hosted at (www.hotelmiracorgo.com) ("Site") or any of the information, data files, written text, graphics, links, audio files, or other sounds, photographs, videos, or other images (together, "Content"), resources, and services, including newsletters (together, including Content, "Services") made available through it, you, as a user or visitor of the same ("User"), agree to and accept:

Through the Site, Hotel Miracorgo provides the User with access to the Services. The Services, including updates, developments, new tools, and/or new web properties, are subject to these Terms of Use.
General User Obligations and Liability
Hotel Miracorgo reserves the right to change these Terms of Use at any time, with the sole obligation to post changes online on the Site, and it is the sole responsibility of the User to check and comply with them each time they are used. Using the Site after posting the changes constitutes acceptance of the updated wording of the Terms of Use. If you do not agree with the changes made or, in general, with the Terms of Use, you must immediately stop using the Site and the Services.
By accessing, using, and downloading materials from the Site, the User agrees, on their behalf and/or on behalf of the entity on whose behalf they are acting, to comply promptly with the provisions of these Terms of Use, ensuring that they have the power to act on behalf of the third party they represent, if applicable.

It is also prohibited for the User to create or introduce any types of viruses or programs that may damage or contaminate the Site or advise third parties to do so.
Rights and Obligations of Hotel Miracorgo.
Hotel Miracorgo reserves the right to:
Modify, add, or remove parts of the Terms of Use at any time;
Modify or terminate the Services for any reason and without prior notice at any time;
Modify, replace, refuse access to the Site and the Services, suspend, or discontinue them, partially or entirely.

Intellectual Property and Personality Rights
Ownership

The User acknowledges and agrees that Hotel Miracorgo retains all intellectual property rights (whether or not registered and anywhere in the world where such rights may exist) in relation to the Services. Hotel Miracorgo retains all rights not expressly granted to the User in these Terms of Use.
The User also agrees not to remove, hide, or alter any notices of intellectual property rights (including copyright and trademark notices) that may be posted or contained in the Services.
Brands and Affiliates
Unless expressly authorized by Hotel Miracorgo, nothing in the Terms of Use gives the User the right to use any registered trademarks, trademarks, service marks, logos, domain names, and other distinctive brand features of Hotel Miracorgo.
Software
Hotel Miracorgo grants the User a personal, worldwide, non-exclusive, non-transferable, and non-exclusive license to use the booking interface on the Site as part of the Services provided ("Software"). This license is solely for the purpose of using and enjoying the booking service as it is made available on the Site, as permitted by the Terms of Use.
The User is not allowed (and cannot permit any third party) to copy, modify, create a derivative work, reverse engineer, decompile, or otherwise attempt to extract the source code of the Software or any part of it, unless it is expressly permitted or required by applicable law or the User has been specifically authorized in writing by Hotel Miracorgo. Unless Hotel Miracorgo has granted the User a specific written authorization to do so, the User may not assign (or grant a sublicense of) its rights to use the Software, provide a warranty for its right to use the Software, or, alternatively, transfer any part of its right to use the Software.
Exclusion of Warranties
To the extent permitted by applicable law, the Services are provided "as is" and "as available," and Hotel Miracorgo does not provide any warranty with respect to them. In particular, Hotel Miracorgo does not warrant to the User that:
The use of the Services will meet your needs or expectations;
The use of the Services will not be interrupted or will be punctual, secure, or error-free;
Any information obtained as a result of using the Services is accurate or reliable; and
Defects, if any, in the operation or functionality of any software provided as part of the Services will be corrected.
No conditions, warranties, or other terms (including any implied terms as to satisfactory quality, fitness for purpose, or conformance with description) are applicable to the Services, except to the extent expressly set out in the Terms of Use.
The User's use of the Site, the Services, as well as any materials downloaded or otherwise obtained through the use of the Services, is done at their sole risk, and the User is solely responsible for any damage to the equipment on which they use or view the Site, the Services, and the materials available there.
Nothing in the Terms of Use shall affect the rights provided by applicable law, to which the User is always entitled as a consumer if you act in this capacity and are related to Hotel Miracorgo. Such rights cannot be changed or waived contractually.

Limitation of Liability
To the extent permitted by applicable law, Hotel Miracorgo assumes no responsibility to the User for:
(i) any damages resulting from the use of the Site and the Services, including travel and/or accommodation booking;
(ii) any damages resulting from:
(a) any User judgment as to the integrity, accuracy, or existence of any advertisement or any relationship or transaction with any advertiser whose advertising is displayed on Hotel Miracorgo's Services or newsletter;
(b) any changes that Hotel Miracorgo may make to the Services or any permanent or temporary termination of the provision of the Services (or any features of the Services);
(c) the deletion, corruption, or error of storage of any content or other data of communications maintained or transmitted by or through the use of the Services;
(d) the direct or indirect violation of the Terms of Use;
(e) the failure to maintain the security and confidentiality of the password or user account details.
Hotel Miracorgo's liability for damages arising from the Site and the Services, caused by Hotel Miracorgo, its representatives, or agents, is limited to cases where it acts with willful intent or gross negligence. If you disagree, in whole or in part, with the Site or the Services or the Terms of Use, you have only the right to stop using the Site or the Services, as applicable, and to request the cancellation of your user account.

GENERAL PROVISIONS
Prevalence
In the event of a conflict between the Terms of Use and other specific provisions or specific terms and conditions existing on the Site regarding certain materials, the latter shall prevail.
Exercise of Rights
The non-exercise or immediate application of rights or provisions by Hotel Miracorgo under the Terms of Use should not be interpreted as a waiver of them.
Completeness
The Terms of Use constitute the entire agreement between the User and Hotel Miracorgo regarding the use and consultation by the User of the Site and the Services and regulate the use of these (excluding any Services that may be provided by Hotel Miracorgo under a separate written contract), fully replacing any previous agreements between the User and Hotel Miracorgo regarding the Site and the Services.
Reduction
The invalidity, declared by a final court or arbitral decision, of any provision of the Terms of Use does not determine the invalidity of the others, and Hotel Miracorgo reserves the right, if necessary, to modify the Terms of Use accordingly to remedy the invalidity.

Any notifications and communications from Hotel Miracorgo to the User under the Terms of Use should preferably be made to the email address or the address provided by the User in their User Account, without prejudice to Hotel Miracorgo being able to use other elements and forms of contact.

Applicable Law and Forum
The Terms of Use, as well as the relationship between the User and Hotel Miracorgo according to them, are governed by the applicable laws of the Republic of Portugal. The User and Hotel Miracorgo agree to submit exclusively to the jurisdiction of the judicial courts of the district of Vila Real to resolve any legal issues arising from the Terms of Use, without prejudice to applicable mandatory legal standards. Notwithstanding the foregoing, Hotel Miracorgo may apply interim measures (or equivalent urgent legal compensation) in any jurisdiction.
